LinkedIn member Rudy Nino starting a discussion on the Qualified
Remodeler group page. He asks advice on what to do when a
homeowner wants to do a partial demolition of a home's interior plasters,
walls and flooring, and the issue of lead paint arises due to the home's
age. He asked: "Has anyone worked with a homeowner under these
terms?" Read on for group members' responses.
"Homeowners are allowed to work in their own homes without any of
the lead rules applying. If he/she does all the demo and you have that
in writing, there should be no problem. Once the lead paint has been
addressed by the homeowner, you are now working in a lead-free area."

"I would disclose the RRP requirements, provide the owner with a copy
of 'Renovate Right,' get a signed acknowledgment of receipt, disclaim
responsibility for demolition and lead paint removal in my contract, and
move ahead. The owner might self-perform or might hire a certified
demolition contractor. All I need is a clean jobsite." Matt Kennedy
"If you work with the homeowner, you open yourself to liabilities as well
as the very real possibility they will slow the job down. My advice is to
tell the homeowner they should complete the demolition they want to
do, and you'll come in and complete your part of the job after they are
done. Also, let them know about the leaded (sic) paint issues and the laws
surrounding them." David Hawkes
"Federal law requires contractors that disturb painted surfaces in homes
built before 1978, be certified and follow specific work practices to
prevent lead contamination. Federal law also requires that individuals
receive certain information before renovating more than 6 sq. ft. of
painted surfaces in a room for interior projects or more than 20 sq.
ft. of painted surfaces for exterior projects, window replacements or
demolition on structures built before 1978." Jeffrey P. Fick
